Under this law, claiming a gender different from your biological sex on official records or to employers could soon be classified as fraud. Texas House Bill 3817 was filed by Rep. Tom Oliverson in March 2025.
The bill introduces the term โgender identity fraudโ, making it a felony to knowingly misrepresent your sex โ the one you were born with โ to government entities or employers.
This would be a state jail felony, with penalties including up to two years behind bars and a $10,000 fine.
The bill doesnโt single anyone out โ it just says if you want to be taken seriously, keep it real when it counts.

Weโve seen too much chaos in schools, sports, and workplaces because people can say โI identify asโ and suddenly rules donโt matter. This bill doesnโt stop you from living how you want โ but when it comes to legal documents and official dealings, facts matter.
